Terms of Service

Effective: September 20, 2026

Last updated: September 20, 2026

Privacy PolicyTerms of Service

These terms govern your use of House Of Ours. Please read them before creating an account, inviting family members, or purchasing a subscription.

1. Agreement and operator

These Terms of Service (“Terms”) are an agreement between you and Nicholas Potter, operating House Of Ours personally in Florida, United States (“House Of Ours,” “we,” “us,” or “our”). By accessing or using the service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and accounts

You must be able to form a binding agreement to use the service. If you are under 18, you may create or control an account only with permission from a parent or legal guardian, who is responsible for your use. You must provide accurate information, safeguard your sign-in credentials, and promptly notify us of suspected unauthorized use.

Archive owners control invitations, roles, and access. You are responsible for activity through your account and for inviting only people who should have access to the archive.

3. Family content and permissions

“Content” includes stories, text, photographs, video, audio, recordings, transcripts, metadata, profiles, tags, and other material submitted to the service. You retain ownership of content you own. These Terms do not transfer ownership of your family archive content to us.

You grant us a limited, non-exclusive, worldwide license to host, store, reproduce, process, adapt, transmit, display, back up, and otherwise use content only as needed to operate, secure, support, and improve the service and provide features you request. This license ends when the content is deleted from our active systems, subject to legal obligations and reasonable backup retention.

You represent that you have the rights, authority, and any required consent to submit content, including content about other people. You must respect privacy, publicity, copyright, recording- consent, and other applicable rights. Invited members may view, copy, download, or export content available to them; use care when choosing members and distributing share links.

4. Memory Calls and recordings

Memory Calls may place calls, ask prompts, record responses, and create transcripts. The archive owner or person configuring a call is responsible for providing accurate recipient information, obtaining all consent required to call, record, transcribe, and store the conversation, and respecting telephone and recording laws in every applicable location. Do not use Memory Calls for emergencies.

A Memory Call uses allowance only after a memory is saved with at least 10 actual spoken words from the original recording transcript, supported by speech evidence. There is no minimum duration. Pending calls reserve capacity. Automated voicemail detection can be wrong; detected voicemail does not record or use allowance. Unknown detection continues without requiring recipient confirmation. Organizer confirmation and the recording disclosure are not verified recipient consent.

Families may correct a saved call as voicemail once. Each paid archive has two manual voicemail-redo claims per monthly included-allowance cycle; each Starter archive has two total, including prior claims. Add-ons and plan changes do not grant extra claims. Technical recovery is separate and does not spend these claims. Processing recovery is limited to three attempts within 24 hours; retained audio stays available under archive storage and retention rules. A restored opportunity replaces the original charge, remains until used across cycle and plan changes, and is not also a refund or an extra credit. No automatic redial occurs and another connection is not guaranteed. Historical records are unchanged.

5. AI-assisted features

The service may use AI to produce transcripts, prompts, image analysis, crops, dates, descriptions, or organizational suggestions. AI output may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing output before relying on, publishing, or saving it. AI features do not provide legal, medical, financial, historical, or professional advice.

6. Acceptable use

You may not use House Of Ours to:

  • Break the law or violate another person’s privacy, intellectual-property, or other rights;
  • Upload content you do not have permission to use or record a person without required consent;
  • Harass, threaten, exploit, defraud, impersonate, or harm another person;
  • Distribute malware, interfere with security, probe systems, or gain unauthorized access;
  • Use automated methods to scrape, overload, or abuse the service;
  • Resell the service or use it to build a competing dataset or model without written permission; or
  • Use the service for emergency communications or unlawful automated calling.

We may remove content or restrict access when reasonably necessary to address misuse or legal risk.

7. Plans, renewals, and payment

Some features require a paid subscription or one-time purchase. Prices, billing periods, storage, member limits, call allowances, and included features are shown before purchase. Taxes may apply. Payment processing is provided by a third party and is subject to its terms.

Subscriptions renew automatically for the selected monthly or annual period until cancelled. By subscribing, you authorize recurring charges to your payment method. You can manage or cancel a subscription through the billing portal available from the service. Cancellation stops future renewals but does not ordinarily reverse charges already processed.

Payments are non-refundable except where required by law. We may change prices or plan features prospectively with reasonable notice. If payment fails, access to paid features may be limited.

8. Cancellation, inactivity, and archive deletion

Cancelling a paid plan may begin an archive retention or grace period after the paid term ends. Inactive free archives may also become eligible for expiration. We may send reminders and give users an opportunity to export or reactivate an archive before deletion, as shown in the service.

Archive owners may schedule deletion in Settings. Owner-requested deletion normally includes an export reminder, member notice, and 30-day grace period. Legal holds or legal obligations may delay deletion. Once permanent deletion begins, recovery may not be possible. You are responsible for exporting content you wish to keep.

9. Copyright concerns

If you believe content available through House Of Ours infringes your copyright or other rights, email support@houseofours.life with your contact information, identification of the protected work, the location of the content, the basis for your claim, and a statement that your report is accurate. We may request additional information and take appropriate action. Knowingly false reports may create liability.

10. Service changes and availability

We may add, change, suspend, or discontinue features. We work to preserve family content and keep the service available, but uninterrupted access, permanent storage, or error-free operation is not guaranteed. Maintain exports of content you cannot afford to lose. Features may depend on third-party providers and supported devices, browsers, networks, or regions.

11. Suspension and termination

You may stop using the service at any time. We may suspend or terminate access for material breach, unlawful use, security risk, nonpayment, or conduct that threatens users or the service. Where reasonable, we will provide notice and an opportunity to export content, but urgent safety, legal, or security circumstances may require immediate action.

Provisions that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, and dispute terms—will survive.

12. Disclaimers

To the fullest extent permitted by law, House Of Ours is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing. We do not guarantee that content, transcripts, AI output, dates, relationships, or other information is accurate or complete.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, House Of Ours and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the service.

To the fullest extent permitted by law, total liability for claims arising from the service will not exceed the greater of the amount you paid to House Of Ours during the 12 months before the event giving rise to the claim or 100 U.S. dollars. These limits do not apply where liability cannot legally be limited.

14. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless House Of Ours and its operator from claims, losses, and reasonable costs arising from your content, your violation of these Terms, or your violation of another person’s rights. This does not require you to indemnify us for our own unlawful conduct.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to rights that cannot be waived under applicable consumer law, disputes will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve the issue informally.

16. Changes to these Terms

We may update these Terms as the service or law changes. We will update the date above and provide additional notice when a change is material. Continued use after revised Terms take effect means you accept them, subject to applicable law.

17. General terms

If part of these Terms is unenforceable, the remainder stays in effect. Our failure to enforce a term is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization or transfer of the service. These Terms and the Privacy Policy are the entire agreement about the service unless a separate written agreement applies.

Personal media copies

Where your archive permits it, invited members may save personal copies of photos, audio and videos they can already access. This does not transfer ownership or give permission for public reuse. Obtain permission from the relevant rights holders and people involved before posting or reusing family media publicly. An archive administrator cannot grant rights they do not hold.

Owners and archive admins can limit app-provided media downloads to owners and admins. This is not copy protection: it does not prevent screenshots or capture of browser-playable media, remove previously saved copies, or revoke separately published Memory Books and QR playback. Those publications retain their own permissions and consent.
